Do I need to be poisoned to get cursed when using claw of the noxious spawn?

When using claw of the noxious spawn, there's a chance of getting cursed and unlocking the achievement "Cursed!". The question is: can I get cursed using claw of the noxious spawn when I'm not poisoned? Or do I need to be poisoned for the curse to happen?

You dont need to be poisoned, just simply put claw on ring slot and keep clicking, sometimes it takes some more time, but its easy achievement :)
